Terms and Conditions

• 1. You acknowledge that once the promoter has confirmed you are the highest bidder, you have entered into a legally binding contract to buy the lot you have bid for from the promoter.
• 2. Successful bidders will be notified within seven days of the closing date of the auction.
• 3. Late, incomplete, defaced or corrupt bids, and bids below the reserve for the lot being bid for, will not be accepted.
• 4. In the event of the promoter being unable to contact a winning bidder within seven days of the closing of the auction, or of the payment not being received, the promoter reserves the right to award the lot to the next highest bidder. The promoter reserves the right to carry on awarding the lot to the next highest bidder until the reserve is reached.
• 5. If, for any reason, the promoter is unable to award a lot, the promoter reserves the right to withdraw the lot from the auction.
• 6. Lots are not transferable and there are no cash alternatives.
• 7. The highest bidder of each lot shall be the purchaser thereof. If any dispute arises as to the highest bidder, the Auctioneer shall determine the dispute and may put up again and re-sell the lot in respect of which the dispute arises.
• 8. (a) The bidding and advances shall be regulated by and at the discretion of the Auctioneer.
• 8. (b) Where an agent purchases on behalf of an undisclosed client such agent shall be personally liable for payment of the purchase price to the Auctioneer and for safe delivery of the lot to the said client.
• 9. (a) The Canadian Art Auction reserves the right to bid on behalf of the clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid.
• 9. (b) The Canadian Art Auction reserves the right before or during the sale to group together lots belonging to the same vendor, or split up and/or withdraw any lot or lots.
• 10. The Canadian Art Auction shall not be liable for any default of the purchaser or vendor unless otherwise indicated each lot is sold as genuine and properly described.

About The Canadian Art Auction

In 1997, artist Chris MacClure opened a Gallery/Studio in Cabo San Lucas Baja, Mexico. Within a couple of years the Golden Cactus Gallery had become the premier gallery in Los Cabos with a stable of over a dozen top painters from Mexico, Canada, United States and other internationally collected artists.

MacClure's 40 years in the art business helped him to navigate the intricacies of operating a business in a foreign country and building the gallery to become a commercially viable enterprise with a burgeoning client base from all over the world. In addition to overseeing the gallery business, running exciting resort show art venues for his artists and painting his own works, he managed to find the time to single-handedly instigate International Artist Day on the world-wide web, which has now gained recognition and support from artists, galleries, and art lovers all over the globe. The October 25th International Artist Day Celebration honors artists for their contribution to society historically and in the present. MacClure knows full well the extraordinary demands that living life as an artist brings and he is passionate about helping the art and artists gain respect and recognition, devoting his time, energy and money to promote the cause.

The CANADIAN ART AUCTION is the latest brilliant brain-child of MacClure's and this time his efforts involve promoting emerging artists and THE NEW MASTERS; those artists who have paid their dues in time, effort and talent but perhaps have not yet been discovered by the world auction houses, as only a small percentage of living artists are accepted; those artists who are more known to the public at large. The Canada Art Auction gives the public an opportunity to discover the works of artists they may not be aware of.

The preferred business paradigm for the 21st century is inclusive and not exclusive and will be for the inspired entrepreneur a major step away from the globalist, mass merchandising way of marketing that has been in place up until now, to a more personal relationship. Artwork from the travels of the artists over the years. From the west coast of British Columbia, Canada & Baja, Mexico.

Some older pieces and some from more recent travels.

Buyers & Sellers

SELLERS

"INVITATION TO CONSIGN"

All styles and subject matter are acceptable. A CAA member will make the final decision as to which auction is best and if there should be a reserve on it.

Whether you wish to sell a single piece of art, or a large collection, there is a way to have your property valued by a CAA expert: e-mail a jpg with the sizes and all other information available or e-mail us on ideas you have.

If need be, complimentary estimates are based on verifiable information. ("Should go for") estimates.

A per unit consignment fee of $10 each for listing without a reserve. Bulk listings can be discussed. A $15 per unit consignment fee for all pieces consigned with a reserve, this reserve agreed by the CAA member and the consignee. All fees to be paid before items are put on the auction site. There is no other fee for the consignee at the present time. All shipping to the auction house and return to consignee for unsold items to be the responsibility of the consignee.

BUYERS

A buyer is to register, log in and bid in the auction.

If the buyer wins the auction an additional 10% commission will be added on to the final auction bid. You will be notified of this again once the auction is closed.

The buyer with the winning bid will be contacted via email to arrange payment via Paypal. This provides the buyer additional security if purchasing via Credit Card/

The sold item will be shipped within a reasonable time after the payment is made by the buyer. Buyer to be responsible for all shipping charges for the item(s) to them.

All buyers will have a 100% guarantee of the product. Full refund if not satisfied within 7 days of receiving item.

AFTER THE SALE

Receive Notification and Payment

After the auction, you will receive a notification that lists the final bid price for your property. If a buyer wasn't found, you should speak with your CAA contact to discuss either re-offering or collecting your property.

Approximately 30 days after each auction, CAA sends payment to sellers along with a settlement statement itemizing the commission and any other charges.
